According to a person aware of the matter, after security personnel swiftly intervened and escorted the lawyer out of the courtroom around 11.35am, court officials sought the CJI’s instructions on how to proceed. “Just ignore,” the CJI reportedly told them, asking that the lawyer be warned and let go.

The lawyer was later identified as Rakesh Kishore, an advocate and resident of Delhi’s Mayur Vihar, registered with the Supreme Court Bar Association (SCBA) as a temporary member since 2011.

Prime Minister Narendra Modi condemned the incident. “The attack on him… has angered every Indian. There is no place for such reprehensible acts in our society. I appreciated the calm displayed by Justice Gavai in the face of such a situation,” he posted on X.

Congress Parliamentary Party chairperson Sonia Gandhi also denounced the breach, calling it “an assault” not just on CJI “but on our Constitution as well”.

The dramatic incident unfolded during the mentioning of cases before the CJI’s bench, when Kishore suddenly approached the dais and tried to remove his shoe. As he was being restrained and taken away, he was heard shouting: “Sanatan ka apman nahi sahenge (We will not tolerate any insult to Sanatan).”

Unfazed by the commotion, the CJI urged lawyers to continue with the day’s proceedings. “Don’t get distracted by all this. We are not distracted. These things do not affect me,” he said calmly, before resuming the hearings.

“Speaking to HT, Kishore said he did not regret his actions as he made several incoherent claims, and suggested he was guided by a ‘divine force’”.

Later in the day, BCI took a stern view of the incident, ordering Kishore’s immediate suspension from practice. “Advocate Rakesh Kishore is suspended from practice with immediate effect. During the period of suspension, you are debarred from appearing, acting, pleading or practising in any court, tribunal or authority in India,” BCI said in its order, adding that a disciplinary inquiry will be initiated against him for conduct “inconsistent with the dignity of the court and BCI rules.”

Delhi Police detained Kishore and questioned him for nearly three hours before letting him go after the Supreme Court’s secretary general, as instructed by the CJI, refrained from pressing any charges. The secretary general also instructed the police to return Kishore’s shoes and documents. “He was questioned by the security unit of Delhi Police and the officials of New Delhi District police after taking approval from the secretary general of the Supreme Court,” said a person familiar with the matter.

According to the person cited above, Kishore had taken off his sports shoes and attempted to throw them towards the CJI at around 11.35 am in Court No. 1, before being apprehended by security staff.

A senior police officer said that Kishore told investigators he was upset over the CJI’s remarks during a recent hearing concerning the restoration of a beheaded Lord Vishnu idol at the Javari temple in Khajuraho, Madhya Pradesh.

Last month, the bench of CJI Gavai and justice K Vinod Chandran had declined to entertain the petition filed by one Rakesh Dalal, observing that the matter fell under the jurisdiction of the Archaeological Survey of India (ASI).

During the hearing, the CJI reportedly remarked to the petitioner’s lawyer: “Go and ask the deity itself to do something now. You say you are a staunch devotee of Lord Vishnu. So go and pray now. It’s an archaeological site and ASI needs to give permission etc. Sorry.”

Following social media outrage over those comments, CJI Gavai clarified in open court on September 18 that his remarks were misconstrued. “Someone told me the other day that the comments I made have been portrayed in social media in a certain manner…I respect all religions,” he said.

Solicitor general Tushar Mehta, who was present in court that day, warned of the perils of misinformation online, noting, “We used to know Newton’s third law — every action has an equal and opposite reaction. But now, every action has a disproportionate social media reaction.” Senior advocate Kapil Sibal added: “We suffer every day. This is an unruly horse and there appears no way to tame it.”

The Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAoRA) both condemned Kishore’s conduct. SCBA said that Kishore was only a temporary member and that it was considering disciplinary action, while SCAORA described the incident as “unbecoming of a member of the Bar” and said it “strikes at the very foundation of mutual respect that sustains the relationship between the Bench and the Bar.”

Leaders from across party lines condemned the incident. “No words are adequate to condemn the attack on the Honourable Chief Justice of India in the Supreme Court itself…Chief Justice Gavai has been very gracious but the nation must stand in solidarity with him unitedly with a deep sense of anguish and outrage,” Sonia Gandhi said.

Tamil Nadu chief minister MK Stalin said the “shameful act” deserved the strongest condemnation. “The reason revealed by the attacker for his act shows how deeply the oppressive and hierarchical mindset still lingers in our society,” he posted on X.

The Aam Aadmi Party also condemned the incident, calling it an assault “on the soul of India”. “A Dalit son reached the highest seat in the country through hard work and honesty—this these people cannot tolerate. Just see their audacity. Their supporters are openly threatening the CJI on social media. This country will never tolerate this kind of politics and thuggery,” AAP chief Arvind Kejriwal wrote on X.

Kishore’s family members expressed anger and embarrassment over his actions. They refused to comment publicly, but Kishore admitted that his relatives were “deeply upset”.

The incident was possibly sparked by CJI Gavai’s comments in a previous case related to the restoration of a 7-foot beheaded idol of Lord Vishnu at Khajuraho. While dismissing that case, he had said,

“Go and ask the deity itself to do something now. You say you are a staunch devotee of Lord Vishnu. So go and pray now. It’s an archaeological site and ASI needs to give permission etc.”

The CJI observation reportedly caused a furore on social media, with many accusing the CJI of hurting religious sentiments. Addressing the controversy in open court two days later, CJI Gavai said that he meant no disrespect.

“I respect all religions…This happened on social media,” he said.

On the alleged attack on the CJI in the Supreme Court, Senior Advocate Indira Jaisingh says, “I am not an eyewitness to the incident; what I know, I know from reading what the press has published. It calls for investigation. I consider it to be an attack on the institution as a whole, not just CJI. NEW DELHI: In an unprecedented and shocking incident, an elderly lawyer attempted to hurl a shoe towards Chief Justice of India B R Gavai in his courtroom in the Supreme Court on Monday, prompting the Bar Council of India to suspend his license with immediate effect.

As the attempt by the lawyer Rakesh Kishore during the court proceedings sparked widespread condemnation, Prime Minister Narendra Modi spoke to the CJI and said the attack was “reprehensible” and angered every Indian.

“The attack on him earlier today in the Supreme Court premises has angered every Indian. There is no place for such reprehensible acts in our society. It is utterly condemnable,” Modi posted on X. The prime minister also praised Gavai for maintaining calm.

The CJI, who remained unfazed during and after the incident, asked the court officials and security personnel present inside the courtroom to “just ignore” it and to let off the errant lawyer with a warning. Police said Kishore was aged 71.

“Don’t get distracted by all this. We are not distracted. These things do not affect me,” the CJI, who was sitting on the bench with Justice K Vinod Chandran, told lawyers and continued hearing the mentioning of cases.

According to lawyers, the incident occurred when the CJI-led bench was hearing the mentioning of cases by lawyers.

Kishore approached the dais on a raised platform, removed his shoe and tried to throw it towards the judges.

Alert security personnel present inside the courtroom immediately intervened and foiled an apparent attack.

The lawyer was swiftly escorted out of the court premises. As he was being taken away, the lawyer was heard shouting, “Sanatan ka apman nahi sahenge” (will not tolerate insults to Sanatan Dharma).

Bar bodies SCBA and SCAORA and lawyers including Solicitor General Tushar Mehta and political parties strongly condemned the incident as “an attack on the Constitution and the institution as a whole”.

Kishore, a resident of Mayur Vihar here, was questioned for three hours by Delhi police officials inside the apex court premises and was later allowed to go at 2 PM as no formal complaint was lodged. Police also returned his shoes to him.

Police sources said a note, containing the slogan ‘Sanatan dharma ka apmaan nahi sahega Hindustan’ (India will not tolerate insults to Sanatan Dharma), was recovered by the police from his possession.

“We also found that he was carrying a card of the Supreme Court Bar Association, and the Shahdara Bar Association. While questioning Kishore, the team asked him about his motive for his act. The advocate has claimed that he was unhappy with the CJI’s remarks during a recent hearing of a plea seeking the restoration of a Lord Vishnu idol in the Khajuraho Temple complex in Madhya Pradesh,” the sources said.

Congress Parliamentary Party chairperson Sonia Gandhi, in a statement, said it is not just an attack on the CJI but on our Constitution and no words are enough to condemn such an act.

“No words are adequate to condemn the attack on the Honourable Chief Justice of India in the Supreme Court itself. It is an assault not just on him but on our Constitution as well. Chief Justice Gavai has been very gracious but the nation must stand in solidarity with him unitedly with a deep sense of anguish and outrage,” she said.

“An attempt to attack the Hon’ble Chief Justice of India in the Supreme Court today is unprecedented, shameful and abhorrent. It is an attack on the dignity of our Judiciary and the rule of law,” Congress president Mallikarjun Kharge said in a post on X.

Solicitor General Tushar Mehta described the act as “unfortunate and condemnable”, calling it a result of misinformation and an attempt at cheap publicity.

“Today’s incident in the chief justice’s court is unfortunate and deserves condemnation. This is the result of misinformation in social media. It is really heartening that the chief justice of India reacted with magnanimity…. I only hope that this magnanimity is not treated by others as the weakness of the institution,” the top law officer said.

Senior advocate Indira Jaising termed the episode “an attack on the institution as a whole”.

The Supreme Court Bar Association(SCBA) expressed its “profound shock, outrage, and unequivocal condemnation” over what it termed a “reprehensible act” committed by an advocate inside CJI’s courtroom.

In a strongly worded resolution passed unanimously, the SCBA described the advocate’s conduct as “utterly unbecoming of an officer of the Court” and said it “strikes at the very foundation of mutual respect that underpins the relationship between the Bench and the Bar.”

The Supreme Court Advocates-on-Record Association(SCAORA) called the incident as a “disrespectful and intemperate gesture” by an advocate.

The Bar Council of India(BCI) swung into action and swiftly ordered immediate suspension of Rakesh Kishore.

Issuing the interim suspension order, BCI chairperson and senior advocate Manan Kumar Mishra said the advocate’s act was “prima facie inconsistent with the dignity of the court” and in clear violation of the professional conduct rules prescribed under the Advocates Act, 1961 and Bar Council of India Rules.

“On the basis of prima facie material, it appears that at about 11.35 am on 6 October 2025, in Court No. 1 of the Supreme Court of India, you i.e. Advocate Rakesh Kishore, enrolled with the Bar Council of Delhi vide enrolment nos…, removed your sports shoes and attempted to hurl them towards the Hon’ble Chief Justice of India during ongoing proceedings, whereupon you were detained by security,” the BCI said.

According to sources, the incident could be linked to the lawyer’s unhappiness over the CJI’s remarks during a hearing last month concerning the restoration of a Vishnu idol in Khajuraho.

A bench headed by the CJI had dismissed the plea seeking directions to reconstruct and reinstall a seven-foot idol of Lord Vishnu at the Javari temple, part of the UNESCO World Heritage Khajuraho temple complex in Madhya Pradesh.

Terming the plea a “publicity interest litigation”, the CJI had said, “This is purely publicity interest litigation…. Go and ask the deity himself to do something. If you are saying that you are a strong devotee of Lord Vishnu, then you pray and do some meditation.”

Taking note of the online criticism of his comments, the CJI later said he respects “all religions”.
