Texas Attorney General Ken Paxton has won a key legal battle against the City of San Antonio, successfully halting its attempt to use taxpayer dollars to fund out-of-state abortion travel.

The Texas Fifteenth Court of Appeals ruled Thursday that San Antonio must suspend its so-called “Reproductive Justice Fund” while litigation is ongoing.

The ruling marks a significant win for anti-abortion advocates in Texas, where strict laws have banned most procedures since 2022. The decision underscores ongoing battles between state officials and local governments seeking to circumvent statewide abortion laws.

San Antonio had allocated $100,000 for the program, which would have which would have reimbursed residents traveling outside Texas for abortions—procedures that are largely illegal in Texas following the state’s post-Roe abortion ban. Paxton sued the city, arguing the fund violated the Texas Constitution’s Gift Clause and exceeded the city’s legal authority.

“Under absolutely no circumstances should any Texas city be funding out-of-state abortion travel, and I will continue to work tirelessly to end this cruel, unlawful, and morally bankrupt program,” Paxton said in a statement.

The attorney general added: “Forcing Texas taxpayers to subsidize abortion tourism is a profound insult to our state’s pro-life values and our laws protecting the unborn.”

A trial court had initially ruled against Paxton’s challenge. He appealed that decision, leading to the appellate court’s reversal on Thursday.
